ANZ Visa Olympic Games Paris 2024 Competition (“Competition”) terms and conditions (“Terms and Conditions”)

Introduction

1. Information on how to enter the Competition and the prizes under the Competition form part of these conditions of entry. By participating in the Competition (including by accepting a prize), a person is taken to have accepted, and to have agreed to be bound by these terms and conditions.
 

2. The “Promoter” is Australia and New Zealand Banking Group Limited (“ANZ”) (ABN 11 005 357 522) 833 Collins Street, Docklands VIC 3008.
 

3. The Competition commences at 12.01am AEDT on Thursday 21st March 2024 and closes at 11.59pm AEST on Tuesday 30th April 2024 (“Promotion Period”).
 

Eligibility

4. Subject to clause 5 below, entry is open to Australian residents who:

    a)   Are 18 years of age or older at the time that the competition commences; and

    b)   are or become an ANZ Plus Account holder, and remain an ANZ Plus Account holder during the Promotion Period; or

    c)    are or become an ANZ Access Advantage, ANZ One, ANZ Pensioner Advantage or ANZ Access Basic account holder; hold an ANZ Access Visa Debit card associated with that account; and remain a holder of that account during the Promotion Period; and

    d)   are not, an employee, contractor, board member or executive management committee member (or a  member of the immediate family of such an individual) of the Promotor or an entity associated with conducting the Competition, or a subsidiary or related entity of the Promoter or an entity associated with conducting the competition at any time from when the competition commences until the prize is accepted (inclusive).

5. For the purposes of clause 4 (d), immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

Entering the competition

6. To enter the Competition, entrants must perform a minimum of one “Action” during the Promotion Period for automatic entry. An Action consists of an entrant completing an “Eligible Transaction” using their ANZ Plus Visa Debit Card or ANZ Access Visa Debit card (either via digital wallet or physical card). An Eligible Transaction is one the Promoter classifies as a Visa Debit card transaction excluding:

    (a) transactions that are not made using an ANZ Plus Account, ANZ Access Advantage, ANZ One, ANZ Pensioner Advantage or ANZ Access Basic account;

    (b) withdrawals, credits and transfers at ATMs or branches; and

    (c) transactions classified by the Promotor as gambling

For the purposes of these terms and conditions:

An Eligible Transaction using a physical card will be awarded one entry while an Eligible Transaction using a digital wallet will be awarded two entries.

An Eligible Transaction using a digital wallet is any Eligible Transaction using a mobile application (for example, on a smartphone or wearable device) that allows details of an eligible card to be added so that the application can be used in place of the physical card. The following are supported by ANZ to be used as digital wallets: Apple Pay, Google Pay, Samsung Pay, Fitbit Pay (for ANZ Access Advantage, ANZ One, ANZ Pensioner Advantage or ANZ Access Basic accounts only), and Garmin Pay.

An Eligible Transaction using a physical card is any Eligible Transaction using an ANZ Plus Visa Debit Card or ANZ Access Visa Debit card that does not use a digital wallet.
 

7. Multiple entries are permitted. Each Action involving a transaction using a physical ANZ Plus or ANZ Access Visa Debit card constitutes a separate entry and each Action using a digital wallet transaction constitutes two separate entries.
 

8. The Promoter reserves the right, at any time, to verify the eligibility and validity of entries and entrants (including an entrant’s identity, age, place of residence and other eligibility to ensure entrants are compliant with these Terms and Conditions) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe is ineligible for the Competition or has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
 

9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
 

The draw

10. The draw for the competition winners will take place at 10.00am AEST on Tuesday  7th May 2024 at Mike Da Silva and Associates, Level 16, 1 Denison Street, North Sydney, New South Wales, 2060 in the presence of an independent scrutineer. Each winner will be notified in writing (including via electronic methods if an electronic address is available).  The Promoter will make reasonable efforts to give this notice by 5.00pm on Thursday 9th May 2024. The names of each winner will be published online at www.anz.com/plus/visagoforgold from Tuesday 14th May 2024, subject to clause 30, for a minimum of thirty (30) days. The postcode of each winner who is a South Australian resident will also be published online unless that winner requests otherwise.
 

11. There will be one (1) draw and fifty-four (54) prize winners.
 

12. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
 

13. The Promoter’s decision is final and no correspondence will be entered into.
 

Major prize

14. The first four (4) valid entries drawn from all eligible entries received will each receive a “Major Prize” as described below:

  • Economy return flights for two (2) people to Paris from the Departure Point, which may be in Sydney or Melbourne, for the winner and their companion (flight associated taxes are included).
  • 6 nights hotel accommodation in a king or twin room at The Hoxton Paris (4-star)
  • Tickets for two (2) people to the Paris 2024 Opening Ceremony (exclusive to ANZ).
  • Tickets for two (2) people to 2x pre-selected (by Visa) events at Paris 2024.
  • Day trip to Champagne region including transport, vineyard tour and lunch
  • 2 Tickets to Moulin Rouge cabaret show including dinner
  • Airport/train station transfers in Paris (via motorcoach)
  • Daily breakfast and light snacks (excluding in-room snacks) at the hotel
  • Paris Metro Card for transport to/from Olympic events
  • Paris Tourist Pass (eg. Hop on, Hop off) ($200 USD value/approx. $304 AUD value as at 23 February 2024)
  • Visa Prepaid Product ($600 USD value/approx. $913 AUD value as at 23 February 2024)
  • Two (2) Visa Gift/Amenities packs ($400 USD value/approx. $609 AUD value as at 23 February 2024)
  • Visa Everywhere Lounge at hotel
  • Visa event, medical and security support staff

Winners who reside outside a 300km radius of the Departure Point will also receive one (1) trip to the Departure Point including:

  • Return economy airfares to transfer from the winner’s nearest connecting airport to the closest Departure Point; and
  • One night’s accommodation in the Departure Point if transfer times from/to the regional airport transfer flight cannot be accommodated on the same day as the flight to Paris from the Departure Point.

For clarity, if a winner resides within a 300km radius of the Departure Point, the additional domestic transfer flight and accommodation component of the prize will be forfeited and not redeemable for cash or any other compensation.

Where required, return ground transfers to the Departure Point will be provided to the winners from their residential address if it is between 100km and 300km from the Departure Point.

15. The maximum retail prize value of each of the above four (4) Major Prizes is up to $70,000.00 AUD depending on the date and point of departure. Values are correct as at Friday 23rd February 2024. The Promoter accepts no responsibility for any variation in the value of the prizes.

16. The winner and their companion are responsible for transport to and from their accommodation to the events and Opening Ceremony however general guidance will be provided by Visa staff. Unless otherwise stated in clause 14 the Major Prize does not include meals, hotel car parking, additional spending money, insurance, transport to and from closest airport in Australia, items of a personal nature, in-room charges or any other ancillary costs. Other hotel incidentals, private transportation to events and transportation other than stated, travel or other insurance, or any other costs of a related, ancillary, personal or incidental nature are not included.

17. The Major Prize outlined in clause 14 must be taken to coincide with the ANZ Visa Olympic Games Paris 2024 and is subject to booking and flight availability. The winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize provider(s) and their service providers. The winner and their companion are responsible for ensuring that they have valid passports, and any requisite vaccinations and travel documentation. Compliance with any health or other government requirements, other travel documentation and any extras of a personal nature (including without limitation in-house mini-bar, telephone, and laundry charges) are the responsibility of the winners and their nominated companion. 

18. If any non-cash prize (or part of any non-cash prize) is unavailable, subject to any written directions from a regulatory authority, the Promoter, in its discretion, reserves the right to substitute the non-cash prize (or that part of the non-cash prize) with a prize to the equal value and/or specification, including a substitute prize (or that part of the prize) in the form of cash payment to the winner’s account that was used for the winning transaction.

19. Winners of a prize outlined in clause 14 must provide the Promotor with details of their nominated companion’s name by 5.00 pm AEST 20 June 2024 and acknowledge that such details cannot be amended thereafter.

20. All flights are non-changeable. Subject to the terms and conditions of the participating prize provider(s) and their service providers, and subject to the unclaimed prize draw clause, if for any reason a winner does not, once the prize has been booked, take the prize (or an element of a/the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

21. The Major Prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

Runner up prize

22. The next fifty (50) valid entries drawn from all eligible entries will each receive a “Runner Up Prize” of $2,000 AUD that will be credited to the winner’s account that was associated with the winning eligible transaction within 14 days of the winner’s acceptance of the prize in accordance with clause 29.
 

More on the prizes

23. Except for South Australian residents, the maximum number of prizes an eligible entrant may win is one (1) prize.
 

24. The total maximum retail prize value of all prizes in clauses 14 and 22 is up to $380,000 AUD (including any applicable GST).
 

25. Prizes, or any unused portion of a prize, are not exchangeable, transferable, and non-cash prizes are not redeemable for cash.
 

26. Tax implications may arise from the prize winnings. Independent advice should be sought.
 

27. The Promoter reserves the right to run a prize redraw in the event of an entrant forfeiting or not claiming a prize. For any prize that remains unclaimed or forfeited as at 11.59pm AEST on Tuesday 21 May 2024, subject to any applicable law, ANZ will conduct a further draw on Wednesday 22 May 2024 at 10:00am AEST at the same place as the original draw. Each winner will be notified in writing (including via electronic methods) by 5.00pm AEST on Friday 24 May 2024 and their names will be published online at www.anz.com/plus/visagoforgold  from Wednesday 29 May 2024, subject to clause 30, for a minimum of 30 days. The postcode of each winner who is a South Australian resident will also be published online unless that winner requests otherwise.
 

28. The Promoter will draw additional “Reserve Entries” and record them in order in case an invalid entry or ineligible entrant is drawn or a prize remains unclaimed or forfeited. For any redrawn Major Prize that remains unclaimed or forfeited as at 11.59pm AEST on Sunday 9 June 2024, subject to any applicable law, the Promoter will award the Major Prize to the first entrant with a non-winning valid Reserve Entry in the order drawn who is able to be successfully contacted, is eligible and accepts the Prize.  This process of contacting such entrants will continue until the earliest of all Major Prizes being successfully awarded or 5.00 pm AEST on Friday 14 June 2024, subject to any written directions from a relevant regulatory body. The names of any winner(s) who accept the Prize pursuant to this clause will be published online at www.anz.com/plus/visagoforgold from Wednesday 19 June 2024, subject to clause 30, for a minimum of 30 days. The postcode of each winner who is a South Australian resident will also be published online unless that winner requests otherwise.
 

29.  As a condition of accepting the prize:

    a) a Winner of a Major Prize must remain an ANZ Plus account holder or ANZ Access Advantage, ANZ One, ANZ Pensioner Advantage or ANZ Access Basic account holder (as applicable) for the duration of the Major Prize or until it is otherwise fully taken;

    b) a winner of a Runner Up Prize or cash prize must remain an ANZ Plus account holder or ANZ Access Advantage, ANZ One, ANZ Pensioner Advantage or ANZ Access Basic account holder (as applicable) until such time the prize is fully taken; and

    c) a winner (and his/her/their companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  A winner’s companion must be 16 years or older. If a winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.

Winners who do not accept a prize in accordance with this clause, will be deemed to have forfeited a prize.
 

30. If a winner forfeits a prize or notifies the Promoter that it does not wish to accept a prize, the publication of the winner’s name as outlined in clauses 10, 27 and 28 will be removed within 96 hours of such forfeiture or notification.
 

Privacy & your information

31. Entrants consent to the Promoter using their name, likeness, image and/or voice if they accept a prize (film, recording and/or and photographs of the same) in any media without remuneration for the purpose of promoting this Competition (including any outcome), and any or future promotional, marketing and publicity purposes.
 

32. The Promoter collects and uses personal information, including an ANZ Plus customer’s transaction information ("PI"), in order to conduct the Competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy and ANZ Plus Privacy Collection Notice, which can be viewed at www.anz.com.au/privacy/centre/policy and https://www.anz.com.au/plus/privacy/privacy-collection/. The privacy policy and ANZ Plus Privacy Collection Notice also contain information about how entrants may update their preferences, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
 

Other terms

33. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to acting reasonably:

    (a) disqualify any entrant; or

    (b) subject to any written directions from a regulatory authority, modify, suspend, terminate or cancel the Competition, as appropriate.
 

34. In the event of war, terrorism, state of emergency, government lockdown, pandemic, or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the Competition or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
 

35. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.
 

36. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
 

37. Except for any liability that cannot by law be excluded or modified by agreement, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents):

    (a) makes no warranties or representations and expressly disclaims any and all liabilities (including for consequential damages) to the type, quality standard, or fitness or suitability for any purpose of all or part of the Major Prize;

    (b) is not responsible for any technical difficulties or equipment malfunction (due to any reason beyond the reasonable control of the Promoter);

    (c) is not responsible for the loss, theft or destruction of all or part of a Major Prize or the loss or theft of a cash prize;

    (d) is not responsible for any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

    (e) is not responsible for any variation in the value of non-cash prizes to that stated in these Terms and Conditions;

    (f)  is not responsible if any of the events for the Major Prize is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter;

    (g) is not responsible for any tax liability incurred by a winner or entrant; or

    (h) does not accept any liability for any personal injury, loss or damage arising from the acceptance, use or misuse of any prize, or the failure to claim or use any prize.
